1. Using Gather
By using Gather, you agree to these terms to the extent permitted by applicable law. If you act for a venue, promoter or other organization, you must have authority to act for it. A separate written agreement with Gather controls if it expressly overrides a conflicting part of these terms.
You must be legally able to enter into the transaction you make. If you are under the age of legal adulthood, a parent or guardian must handle transactions that require an adult. Children under 13 may not create an account. You must also meet an event's age and admission requirements; purchasing a ticket does not waive them.
2. Gather's role and organizer responsibilities
Gather supplies ticketing and event-management tools. Unless an event expressly identifies Gather as its organizer, the named venue or organizer operates the event and is responsible for its descriptions, admission decisions, safety, accessibility arrangements, permits, staffing, event delivery and event-specific terms.
Organizers must provide accurate event, price, refund and contact information, honor their published commitments, use guest data lawfully, obtain required permissions and comply with applicable consumer, tax, messaging and employment laws. They must assign staff access appropriately and protect information exported from Gather.
3. Accounts and security
Provide accurate information and use only accounts, payment methods and contact details you are entitled to use. Keep sign-in codes, passwords, scanner PINs and private links secure. You are responsible for activity you authorize and must notify support if you suspect unauthorized access. Do not impersonate another person or bypass access controls.
Some events allow guest checkout; others require a confirmed account. Account access, ticket recovery and certain changes may require proof that you control the relevant email address. Features may differ by role, organizer settings, location and provider availability.
4. Orders, prices, fees and tips
Review the event, date, admission type, quantity, age restrictions, organizer terms and final total before ordering. Reservations and waitlist offers may expire. Availability is checked during checkout, and an incomplete payment or temporary inventory hold is not a confirmed purchase. Follow the confirmation and payment instructions shown for your order.
Checkout displays the amount payable, including applicable mandatory fees and any optional additions you select. Depending on the event, service fees may be included in the ticket price or passed to the buyer. Organizer charges and any applicable taxes are shown in the purchase flow. An event's configured fee treatment applies to that order.
Tips are optional. 100% of your tips go to event staff. The organizer receives the tip funds for distribution to its event staff. If you select a tip, the checkout total and any applicable percentage-based service fee update before you pay.
Card payments are processed through Stripe. Where an organizer offers cash, follow the displayed cash-payment and admission instructions; receiving a cash ticket does not prove that cash has already been collected. Organizer payouts, processing charges, refunds and disputes are also subject to the organizer's applicable payment-provider arrangements.
5. Tickets, admission, transfers and waivers
A ticket provides the admission described for that ticket, subject to its validity and the organizer's disclosed rules. Duplicate, refunded, voided, transferred or previously used codes may not admit you. Keep ticket links and QR codes private. Use supported transfer controls where available; forwarding an email does not necessarily transfer ownership or change the named guest.
An organizer may require matching identification, an age check, checkout answers or a separate waiver. When ID numbers are requested, provide information only for guests you are authorized to represent and tell them it will be used for admission checks. Some ID-restricted tickets cannot be transferred. A ticket purchase does not guarantee entry if a guest fails the disclosed admission requirements or applicable law.
Event-specific terms and waivers are separate from these platform terms and are presented where required. Turning off a waiver for a later purchase does not erase an agreement already signed. Nothing in these terms replaces a separately presented waiver or gives an organizer rights that applicable law prohibits.
6. Changes, cancellations, refunds and disputes
The organizer's disclosed refund and cancellation policy applies, subject to rights required by law. Contact the organizer about event changes, cancellations, admission disputes or refund requests. Gather support can help route a request and investigate platform or payment errors. A published policy cannot remove refund rights that applicable law requires.
Refund eligibility and which fees are refundable depend on the event's disclosures, the reason for the refund and applicable law. If an event is canceled or materially changed, review the organizer's notice and your legal options. Approved card refunds are returned through the payment provider and may take time to appear.
Contact support promptly about an incorrect or unauthorized charge. These terms do not limit your right to raise a good-faith payment dispute or exercise statutory consumer rights. Refunds, cancellations and transfers can invalidate the original ticket.
7. SMS program terms
Where enabled, Gather Tickets SMS provides requested ticket links, purchase confirmations and related order or event-service messages. A venue's promotional text program is separately identified at opt-in and may include event announcements or offers from that venue. SMS is available only where offered in the purchase or subscription flow. Reading or accepting these terms does not itself enroll you in a text program.
You join a program only through its disclosed opt-in process using a mobile number you are authorized to use. Ticket and service-message permission does not enroll you in promotions. Consent to promotional messages is not a condition of purchase. Creating an account, following a venue, signing a waiver or entering a phone number without the relevant permission does not by itself authorize promotional texts.
Message frequency varies based on your orders and requests or the promotional program's disclosed frequency. Message and data rates may apply under your mobile plan. Messages may be sent using automated technology. A ticket text generally contains a link to your tickets; it is not a guarantee of admission or proof that an unpaid cash order has been paid.
Reply STOP to the sending number to opt out of that sender or program. You may receive one confirmation of your opt-out. Reply HELP for help, or email matthew@gathertickets.com. To request a broader messaging opt-out, contact support and identify the programs or senders involved. Stopping texts does not cancel your order, and we will not use another number to evade your request.
You can use your order link and, where available, email or your Gather account to access tickets without SMS. If your number changes or is reassigned, stop the old subscription and update your information before requesting further texts. Do not enroll someone else's number without authorization.
SMS delivery is subject to carrier, network, device and provider conditions and may be delayed or fail. Carriers are not liable for delayed or undelivered messages. Keep your order confirmation and allow another way to access your tickets. Our Privacy Policy explains how phone numbers and messaging permission records are handled.
8. Email and other notifications
We may send purchase, recovery, account-security and requested service messages needed to operate your account or order. Optional venue announcement emails and other promotions follow the applicable consent and unsubscribe choices. Following a venue in Gather is separate from requesting email or SMS promotions. You can control app push notifications through your device settings.
9. Acceptable use and content
Do not use Gather for unlawful events, fraud, ticket counterfeiting, unsolicited messaging, harassment, malicious software, unauthorized data collection or interference with the service. Do not evade inventory, payment, identity, messaging-consent or staff-access controls. Organizers must not upload contacts without a lawful basis or override recipients' opt-outs.
You retain rights to content you submit. You grant Gather permission to host, display, transmit and otherwise use it as needed to provide, secure and support the features you request, including public display of published events and any profile information you choose to make public. You must have the rights and permissions needed for that use. This permission does not transfer ownership of your content to Gather.
Gather's software, branding and other original service materials remain owned by Gather or its licensors. You may use them only as authorized for normal use of the service or under a separate agreement.
10. Privacy and third-party services
Our Privacy Policy describes Gather's handling of personal information. Organizers must also give required notices and honor applicable privacy and messaging obligations when collecting or using guest information. These terms do not grant permission for unrelated marketing or the sale of SMS consent records.
Payments, messaging, maps, embedded media and other connected features may depend on third-party services and their terms. External websites and organizer policies are not controlled by Gather. Review the applicable provider or organizer notices before submitting information directly to them.
11. Availability, suspension and termination
We work to keep Gather available, but features may be interrupted, changed or discontinued. We may restrict access or suspend misuse, security threats, unlawful activity or material violations of these terms. Where practical and legally appropriate, we will provide notice and an opportunity to address the issue. Contact support if you believe a restriction is mistaken.
Account closure or access restrictions do not erase existing payment, refund, privacy or legal obligations. If you need existing order records or help accessing valid tickets, contact support. We may retain records as described in the Privacy Policy.
12. Warranties and responsibility
Except for commitments we expressly make and warranties or rights that the law does not allow us to exclude, Gather is provided on an as-available basis. We do not guarantee uninterrupted operation, successful message delivery or the conduct and performance of independent organizers. Organizers remain responsible for delivering their events and their own promises.
To the extent permitted by applicable law, Gather is not responsible for indirect or consequential losses arising from use of the service. Nothing in these terms excludes or limits liability for fraud, willful misconduct, gross negligence or any other liability that cannot lawfully be excluded or limited. Your mandatory consumer, privacy and refund rights remain intact.
13. Changes, questions and resolving concerns
We may update these terms as the service changes. We will identify the updated version by the date above and provide additional notice or obtain agreement where required by law. Changes do not retroactively remove rights attached to an existing purchase. If part of these terms is unenforceable, the remaining terms continue to apply to the extent permitted by law.
Contact Wave Dynamics Inc DBA Gather Tickets at matthew@gathertickets.com about these terms, messaging programs or a concern with Gather. We will try to resolve concerns directly. These terms do not require binding arbitration, waive class-action rights or prevent you from using courts, regulators or other remedies available under applicable law.
